Orders are accepted subject to crop conditions, delay or injury to our nursery stock due to accidents, floods, hail, etc.
Turner & Son Nursery warrants to the extent of the purchase price that nursery stock sold is true-to-name and as described within recognized tolerances. Seller gives no other further warranty, expressed or implied and will under no circumstance be liable for more than the invoice value at the purchase. All shipments travel at the risk and expense of the purchaser. WE RESERVE THE RIGHT TO CLAIM THE TOLERANCE IN HEIGHT, AS SET FORTH IN THE AAN STANDARD GUIDE, FOR SLOWER GROWING TREES AND CHARGE ACCORDING TO CALIPER.
Freight is due on delivery. Unless any previous arrangements are made before shipment, payment is to be made on arrival for freight on all truck or partial truck loads.
Claims for errors, shortages, or damage must be reported to our office within 10 days of delivery. We give no warranty, expressed or implied as to the life, description, quality, productiveness, or any other matter regarding any nursery stock that we sell.
